I have had many refuse field sobriety…. Don’t matter the blood and breath tell all. Not that it apparently matter in Wisconsin with such petty repercussions. The sobriety tests are just a way to develop PC to do the blood test if you refuse PC is automatic.

No doubt about the blood breath is also sketchy. Field is trash and in this case she had very little probable cause to instigate arrest which she did.

And I was kind of surprised Shane didn't defend his sisters in law enforcement. And then epiphany...Shane also didn't respond to the AI generated picture of him as "Taylor Swift"...........Shane is working undercover at the Chicken Ranch Brothel......well, hopefully undercover. there is no way in hell I would submit to a field sobriety test...take me in, lets do a blood test..or get a breathalyzer out here whatever...but no way on the FST.
I dont drink. But I cant pass one of those on my best day...between broken back, worn out knees, and RRMS... no way...they would drag my arse straight to jail certain I was drunk, lol.

I did have a cop buddy that let me in on a secret though... a big part of that FST is not to determine if a guy is impaired...but to get them to admit it.

That’s generally where the defense lawyer will attack. One mistake or missed step and then the Lawyer can have the results after the fact thrown out such as blood of breath. Obviously there are more signs that point toward impairment, like the smell of an alcoholic beverage, bloodshot and watery, eyes, slurred, speech, etc..

Once you decline, the FST’s PC is automatic and you’re automatically booked and either blood or Breath is done there’s nothing for the Lawyer to attack that the cop could’ve screwed up to get you to that point.

I’ve had countless people over the years that voluntarily do the FST’s and passed them with flying colors and are free to go. Even with signs of impairment.

As someone who has family and friends that are LOEs you would not believe the stories they tell about female officers.

Shane for sure knows if he’s n experienced officer but might not say here.

yeah I did it once when I was a kid..dont get pulled over too often, lol...especially for DUI..
but with my health issues now, there is no way I could pass one.

Well, oaken1, I don't think police pull you over and ask you to do fst's just for the heck of it. Normally, there are other driving conditions that you are stopped for, i.e., speeding, weaving, slow driving, accident, plus many more.
Then, there is the encounter with the officer, the smell of liquor on your breath, slurred speech, disheveled appearance, balance.

And probably more things than I am missing. So, I would venture to guess, that when you are asked to do the roadside fst's, that the officer is probably real close to already arresting you whether you do them or not. Maybe Shane can confirm or deny that?

First context, I lived most of my adult life in the US, it's just right now I'm in the UK. My background is NOT LE but large scale IT.

A FST IS by definition subjective, based solely on the LEO's subjective opinion. You can argue they are trained but it is unarguably subjective. A subjective test which will be entered into evidence against you. Like I said I have zero problem with using a handheld beath test to achieve the same objective, it is based on facts not opinions.

I wasn't clear on the intimidation comment, so to clarify. An LEO can use intimidation to coerce you into taking a FST. It runs along the lines of "Consent to the FST or will have to take you to jail for an blood test or an evidence calibrated beath test as we don't have a mobile test" (mobile tests are not accurate but are good enough to generate probable cause for an arrest).

And yes there are still some PDs that are accused of having DUI arrest quotas

Huge flaw in this. FST’s don’t just find pc for DUI alcohol. They also find pc for DUI drugs.

While, alcohol drinking, and driving is a huge problem. So is DUI drugs, and it becomes more of a problem as it becomes legal in more places. And that’s not even counting the illegal drug variety of DUIs. Of which a lot occur. Handhelds are completely worthless in this instance. While, I understand where you’re coming from handheld’s are without a doubt, less accurate and can be thrown off calibration easily and cause false positives from simple things like mouthwash that you could do right before you leave your house.. there’s a reason they are completely in admissible in court.

So based off what you’re telling us am I my to assume that Europe/UK just allows people to drive around high, no problem no crime whatsoever?

I personally think the HGN should be the litmus test anyway. But those can still be refused.

OT: Unrelated story to the European traffic enforcement. I was in the army, in Germany in the 20th century...LOL, '80-83. And while driving, I was pulled over by the Polizei. I was told I was speeding, which I wasn't, and for 20 Marks (about $10 at the time) he would let me go without a ticket. I paid the extortion.
OMG, this memory just popped in my head, sorry.....a friend of mine came over to Germany to see me and we went to a "strip club/brothel. We were watching a very sexy young girl dancing with a feather boa concealing her breasts. Then she turned around, dropped her g-string, turned around and a big "thang" dropped down between her legs......we left so fast, and for some reason just laughing our arses off....we decided Europe was to advanced for us.........LOL
