so if you want to buy assault weapons go to Arizona?

It is amazing to me that the 49ers had that information ages ago and still waited this long to urge the guy to seek help. All about winning at all costs.

Ya, and letting him play within days after the arrest was an all time great NFL decision.

Ha what a classless douche. Sure we may not break any sack records but at least we got good character in our players and don't have to worry about them missing any game time. Surprising he didn't end up with bengals since they usually have players with character issues.

He allegedly had a domestic incident with his baby's mother. If proven true, beating a woman is worse than gun charged, sorry but that is the truth. Unless he killed someone that is.

Context is key.

If he was defending himself and his strength got away from him vs. a shooting with an intent to injure or kill, the gun thing may be worse.

If DWash beat her up for no good reason vs. someone whipping out a gun to show off at a party and it goes off...well, then his is worse.

Just don't have all the facts yet and I wonder if we ever will.

If proven true then yes but in another post here it said that smith threw a party shot into air and bullet hit a guest and getting sued. Take that and a Factor in the fact he's a whiner and you got yourself a lowlife (to be fair the "whiner" accounts for most of that).

I thought the victim didn't name him as the "shooter" at the party, just an instigator of the shooter. Not sure what that means. Sounds to me like the victim wants a payday by going after the guy with the cash and the incentive to settle instead of the guy with the gun.

I could be wrong.

Oh wow. One second thought, let him play on Sunday...as long as he promises to use that kind of decision-making ability on the field.

From the civil suit it looks like Smith has an uphill climb

He hosted a party at his home, charged a cover to get in and then sold drinks.

The defense is basically saying that the plantiff engaged in willful misconduct, that he understood and accepted the known risks and therefore accepted all risk of harm and that other parties were responsible for the damage so Smiths portion should be diminished in proportion

While I think Smith may not get tagged with the whole amount - I think it's absurd to say that a known risk that you assume when going to a party is that the host is going to start firing weapons and that others are going to shoot up the party ..... I don't find that reasonable at all.

I find it curious that it took so long for the gun charges to come down, but it's probably due to the publicity of the civil suit providing pressure ..... when Harbaugh speaks of "Above Reproach" I think that was his viewpoint in reference to the law that the 49ers seemed to have

Speaking of which, I would love to see an investigation on how the guns that he purchased while in AZ for a football game made it back to CA .... but I doubt that is ever addressed

Just heard that on the radio coming back from Home Depot. Apparently there's some thought that if he took the guns back on a team flight, which is likely, that it violates multiple clauses standard in ever NFL contract which would essentially give the NFL the right to really throw the book at him.

Obviously they didn't just find out today there were assault weapons there so I have to assume they were just waiting for an NFL ruling, but then when he got in even more trouble with drugs and alcohol they just decided we need to get this kid in rehab?
