Wow. Another black eye for Smith. Could mean a suspension from the league.

If it's a 4 game suspension he misses the first Cardinals game.

I guess it depends on where he is at as far as infractions with the league. It could play out til the end of the season like D Wash's is going to. If the league consider's the first incident as a prior, then it will be a suspension for sure. I don't think first timers get 4 games though. Harbaugh could suspend him too, but we all know he isn't that classy.

You don't need to be a "1st timer" to get a big suspension. A DUI is worse than a failed drug test. It's a huge black eye for the league. I think a suspension is on the near horizon.

So let's see, Mr. Smith has a reduced charge prior that relates to an alcohol offense, has been a passenger in a car that flipped avoiding a deer, has been involved in a stabbing, was involved in that fun party where guns were blazing and now a DUI arrest

I guess this just sticks with the 49ers goal to be above reproach ...... then again, they can do what they want, they're the 49ers

I was referring to D-Wash's felony charges, should have clarified.

In the suit filed earlier this month in Santa Clara County Superior Court, David Kleczek, an attorney for Ronndale Esporlas, claims that Smith and former Niners tight end Delanie Walker fired weapons illegally during a party at Smith's San Jose home on June 29, 2012.

The players charged a $10 admission and $5 per drink, the lawsuit said.
Smith, 23, and Walker, who is also named in the suit, were allegedly intoxicated on Smith's balcony when they later fired gunshots in the air while trying to end the party, the lawsuit said.

7am on a Friday morning seems to be a real strange time to get a DUI. Was he drinking all night? Did he get up early and start drinking? What an idiot.

i would assume all night. Being that drunk at 7am would mean a lot of alcohol in an hour

Around the Horn also said he was caught with pills. Didn't say what kind.

Jackie McMullan(sp) basically said it was the trifecta with alcohol, drugs, and pills.
