In a new statement Tuesday evening, the NCAA further defended the implementation of its age-based eligibility rules. Chief legal officer Scott Bearby also said the association is asking the Tenth Circuit to “permanently reverse” Judge Charlotte Sweeney’s injunction.
Sweeney denied the NCAA’s request for a stay pending appeal in a ruling Monday night. Members of the Class of 2022 also have an Aug. 14 deadline to file a response to the emergency motion, and the NCAA’s reply brief is due no later than Aug. 17. The injunction remains in effect.
Bearby said the NCAA considered the idea of retroactively applying the new eligibility rules, which would have given members of the 2022 recruiting class another year. However, the association decided not to go that direction and stands by that decision.
“The Division I Cabinet, including its student-athlete members, carefully considered whether to make the age-based eligibility rule apply retroactively, and decided that doing so would not be in the best interest of all current and future college athletes,” Bearby said.
“We stand behind and will continue to fully defend the membership’s decision. The injunction should never have been granted, and we have asked the Tenth Circuit to permanently reverse it.”
