The legal fallout from the plane crash that killed NASCAR veteran Greg Biffle and his 15-year-old daughter Emma is continuing to unfold months after the devastating December 2025 tragedy.

According to court filings first reported by Yahoo Sports, Biffle’s ex-wife, Nicole Lunders, has filed a wrongful death lawsuit connected to the fatal crash near Statesville Regional Airport in North Carolina.

The lawsuit comes as federal investigators continue examining the circumstances surrounding the crash of the Cessna Citation jet, which went down while attempting to land in poor weather conditions on December 18, 2025.

Six people were killed in the crash, including Greg Biffle, Emma Biffle, pilot Dennis Dutton and several other passengers.

The filing marks another emotional development in a case that has shaken the NASCAR community for months, particularly because of the loss of Biffle’s daughter alongside the former Cup Series star.

Investigation Into Crash Remains Ongoing​


Federal investigators have not yet released a final determination on what caused the crash.

However, preliminary findings from the National Transportation Safety Board previously indicated investigators discovered several mechanical and instrument-related issues tied to the aircraft.

Among the concerns outlined in early reports were alleged electrical problems, instrumentation failures and issues that may have affected the pilot’s situational awareness during the aircraft’s final approach.

Investigators have repeatedly emphasized that the probe remains active and that no official probable cause has been determined.

The wrongful death lawsuit is expected to bring additional scrutiny to the aircraft’s maintenancehistory, operational decisions and other factors connected to the crash.

NASCAR Community Continues Mourning Greg Biffle​


Biffle remained one of the most respected drivers of his generation long after stepping away from full-time NASCAR competition.

A champion in both the NASCAR Truck Series and Xfinity Series, Biffle later became a longtime Cup Series contender and one of the defining drivers of the 2000s era.

Following news of the crash last year, tributes poured in across NASCAR from former teammates, drivers, teams and fans remembering Biffle’s toughness behind the wheel and his impact on the sport.

But beyond the racing accomplishments, much of the grief centered around the heartbreaking loss of Emma Biffle, who died alongside her father in the accident. Biffle’s wife, Cristina, and the couple’s young son, Ryder, were also among those killed in the crash.

As the federal investigation continues, the lawsuit now adds another difficult chapter to one of the most tragic stories the NASCAR world has faced in recent years.
