Dak Prescott sought joint custody of his children with Sarah Jane Ramos after calling off their engagement, but the pair postponed the first hearing in hopes of figuring things out without a judge.
On March 17, the 32-year-old NFL player took steps to determine how he and Ramos will co-parent their two daughters — Margaret Jane Rose, 2, and Aurora Rayne, 10 months — by filing a Suit Affecting the Parent-Child Relationship (SAPCR) case in Texas, where the exes live. A hearing was scheduled for the suit, but the couple “mutually postponed” the meeting to figure things out outside of court, Ramos’ lawyer, Raymond Rafool, told PEOPLE.
The filing, obtained by Us Weekly on Sunday, April 5, states that “the parents of the children are separated,” legally confirming the couple’s split shortly after PEOPLE first confirmed that the Dallas Cowboys quarterback and his fiancée had broken up.
It next states that “the appointment of the parents as joint managing conservators would be in the best interest of the children. It is in the best interest of the children that [Prescott and Ramos] be appointed joint managing conservators of the children.”
Per the filing, Prescott and Ramos would be unable to remove their daughters from Texas without the written permission of the other parent, according to Us Weekly. The football player also requests that the exes avoid any communication involving “vulgar, profane, obscene or indecent language,” per the outlet.
An initial hearing was scheduled for the case, but the former couple decided to postpone it, instead hoping to resolve their issues outside of the courtroom, their lawyers say.
In a statement to PEOPLE, Ramos’ attorney, Rafool, said, “The hearing Dak Prescott set for temporary relief last week was mutually postponed for the parents to attempt to address their and their children’s lives.”

“Sarah Jane is happy with this approach and believes it is in the children’s best interest, which she always held and holds as her primary concern,” the attorney added of his client. “Sarah Jane is and has always been a mother first.”
Prescott’s attorney, Levi G. McCathern II, shared a similar statement with Page Six, stating, “The case is not resolved, but the parties have agreed to postpone the first hearing in an attempt to work out all of the various issues without court intervention.”
The NFL star, McCathern said, “is an absolutely phenomenal father and is looking forward to working with Sarah Jane to develop a healthy co-parent relationship and do what is in the best interests of his children.”
If Ramos and Prescott are unable to resolve their issues outside of court, there is another hearing set for the morning of April 16, per court records viewed by PEOPLE. The exes have until this date to produce documentation about their ability to pay child support, per Us Weekly.
Representatives for Ramos and Prescott did not immediately respond to PEOPLE’s request for comment on Sunday, April 5.

As she and Prescott navigate their split, Ramos celebrated Easter with her daughters. The wine and spirits specialist posted a photo of two Easter baskets on her Instagram Stories and wrote, “Easter when you’re a girl mom >.”
News that she and Prescott — who were first linked in September 2023 and got engaged in October 2024 — had split came just five weeks before they were expected to wed in Italy.
At the time, a rep for Ramos told PEOPLE exclusively that the pair were "both heartbroken that they’re not getting married."
Despite previous reports of the contrary, the rep added, "There wasn’t any rockiness in the lead up, and there was no big argument or blow up. It was a mutual decision."
