Former Texas Longhorns offensive lineman Cole Hutson hopes to suit up in burnt orange and white this fall in a fifth season on the Forty Acres is suing the NCAA in Travis County for an extra year of eligibility via immediate emergency injunctive relief in the wake of the organization implementing a five-for-five model that applies to athletes from the 2023 class onwards.
Filed by Collin County attorney David Obard, Hutson “challenges defendant’s Seasons of Competition Rule in NCAA Bylaw 12.6 as applied to him in light of defendant’s recent rule change allowing football players graduating high school after 2022 to compete in five seasons of competition without needing to redshirt.”
“Defendant’s arbitrary application of this bylaw to plaintiff unfairly limits the number of games he can participate in during his five-year eligibility window, restrains his ability to further develop, restrains his ability to earn scholarship money as a student athlete in pursuit of his Master’s Degree, and restrains his ability to earn money through the use of his name, image, and likeness (NIL),” the suit reads.
A member of the 2022 recruiting class out of Frisco, Hutson signed with Texas as a consensus four-star prospect ranked as the No. 362 player nationally and the No. 13 interior offensive lineman.
With the scholarship expansion going into effect this year, Texas has a roster spot for the 6’5, 308-pounder, who made 48 appearances with 23 starts for the Longhorns over his four-year career. As a freshman in 2022, Hutson started all 13 games at right guard before serving in a reserve role over the next two seasons. In 2025, Hutson began the season as the starting center before missing three games due to injury. Upon his return, Hutson started the final five games of the season at left guard as classmate Connor Robertson took over the starting center role.
Hutson went unselected in the 2026 NFL Draft.
If Hutson does receive the temporary injunction to play this season, he would likely compete for the open starting role at left guard, where Andre Cojoe and Western Kentucky transfer Laurence Seymore are considered the top contenders.
With the filing of the lawsuit, Hutson joins other former Texas athletes like basketball players Jordan Pope and Chendall Weaver in seeking a fifth season of eligibility.
