Apparently due process isn't all that important anymore, once you've been eliminated from the playoffs.

So it would seem.

Even the local media is all over them on this. It's completely inconsistent with their earlier stance that they weren going to let due process run its course.

The claim from them is it's a pattern of bad behavior but they waited out the first one and no charges were filed, largely because his fiancee declined to press charges. Anybody who knows a thing about DV can tell you how common that is, the woman is either scared, or financially motivated to not press charges.

So what pattern are they talking about, the first one never actually happened.

I looked at this guys rap sheet earlier, and man does he have a long list of running into trouble with the law. The 49ers should've sooner but hindsight is 20/20

I didn't know you could find rap sheets online easily, that would be interesting.

The point here that always annoyed me, which is why the Bay Area media was so remiss in making it, was that clearly the 49ers knew McDonald did something. The initial story was the police were called to his house twice in a short time span about potential domestic violence issues.

one of the issues delaying the case was that, which wasn't widely reported, the night of the 2nd incident, around the same time that the alleged victim called 911, Ray McDonald himself called police. Or to be clear he called ONE cop, on his private number. The guy was a San Jose cop, who also worked private security details for... the 49ers! So McDonald clearly realized the fiancee was calling 911, so he called his cop buddy to see if the buddy could help.

Kawakami was on this before but nobody seemed to notice. He was openly suggesting that the 49ers close relationship with the local police influenced the McDonald case.

I suspect having bent over backwards and apparently broken rules/laws to make the first case go away, the 49ers were none too interested to do it again.

I have to admit I really like Tim Kawakami. He may be a bit pompous and holier than thou but for years he has been the one Bay Area writer who's not afraid to point out when the emperor is butt naked, and he's been doing that for awhile with the Niners over mcDonald.

Yesterday people in the Bay Area were actually mad they released him, because it's inconsistent with their past due process statements. now it's starting to get out about the incident I mentioned several months ago with Aldon Smith in a road rage situation where he followed another car into a parking lot a few blocks from the stadium and shouted threats at the other driver. 911 was called, and it turns out Smith called security who dispatched a SJ cop, apparently the same on involved in the Mcdonald case. So you have an incident occurring literally on the border of Sunnyvale and Santa Clara, and 49er security dispatches a San Jose cop, who then convinces the Sunnyvale or Santa Clara police not to do anything to Smith. He convinces the other driver not to press charges, there are even rumors the guy was given 49ers tickets although that's pure speculation.

Apparently the cop was already disciplined by his superiors for his involvement in the McDonald case, if he was also involved in the Smith one he may get fired.

if the Smith case turns out to be true, and there are business owners in the parking lot who saw the whole thing, Smith may be the next 49er to get released.

The NFL has a problem, they need to send a message to the players doing this sort of stuff. I hope the Cards do so with Washington, and I hope the rest of the league does so with guys like this in the future. Make the point loud and clear, being good at football doesn't make you above the law.

The NFL needs to send a message to management that covering up a players issues is just as bad as what the players does. Some front offices are just enablers.

I'm including management in the NFL. But I agree there are apparently front offices enabling here.

Why in the world would a San Jose cop be called to scene of an incident that borders Sunnyvale and Santa Clara? That incident happened right at Lawrence Expressway, one side is Sunnyvale, the other is Santa Clara, neither side is in San Jose.

yes a few blocks down and it's now San Jose, but the point is the incident didn't happen in San Jose, the security for the 49ers knew that, but they called a San Jose cop to go and help keep Aldon Smith out of jail.

It'll be interesting to see if Smith is back with the team next year either.
