Just stupidity in action, IMHO.

1. Don't play with a shotgun
2. Always treat a gun as if it is loaded
3. Don't move a body after an "accidental" shooting

I am a Lakers' fan and was a big Nickey Maxwell Van Exel fan, but his kid was/is a friggin' idiot. Not "accidental" if you ask me.

http://edition.cnn.com/2010/CRIME/12/31/texas.van.exel.killing/

"If a person is making the assertion this was an accident -- you place the body in a vehicle and moved it to a second location -- that in itself, coupled with the fact that property is missing, makes this a capital murder," said Deputy Chief Craig Miller.

Wow looks like his bail went from one million to $25,000 and he is now out on bail. That is crazy!! Yes BIM I am gonna have to say I agree with all of your points. The whole moving the body seals the deal for me. A sad event for all families involved I can't even imagine.

Isn't murder premeditated? This sounds like manslaughter. How do they get murder out of this?

C'mon! Who here hasn't accidentally killed their friend. Don't throw stones in glass houses.

Murder 1 is premedited i think, while Murder 2 is kinda impulsive.

either way if this is accidental it should be manslaughter

Why is it murder? See 1., 2. and 3. above.

Calling murder-by-firearm anything less is just absolving the killer of responsibility. That's a bad lesson to teach.

Would any of us make light of it if a member of our family was the victim?

A car can kill, but it is not the purpose of it. A gun can kill, and it is the purpose of it.

Its not making light of it to hope that the justice system assigns the correct punishment for the act. From this distance I have no idea if it was an accident or not but hopefully the system will work the way it is supposed to. So far it appears to be doing that.
