The lawyers of the alledged victim told the media there was a police recording where Araiza told her to "get checked for STD's" but that was never confirmed by anyone else. And considering the law decided there was no case that should be viewed with doubt. And how did she get his number? Did Araiza rape an underage girl then say "Here's my number if you want to press charges"?

Has anyone even read the follow up on this? This is the press release from the San Diego DA. From the people prosecuting the case.

“Ultimately, prosecutors determined it is clear the evidence does not support the filing of criminal charges and there is no path to a potential criminal conviction,” a statement released by the office of Summer Stephan, the San Diego County district attorney, said. “Prosecutors can only file charges when they ethically believe they can be proven beyond a reasonable doubt.”

Does this sound like the usual "Well we think he did it but we just don't have enough" you get from a DA?

Araiza's lawyer said that 35 witnesses from the party were interviewed and "witnesses said the teenager was not drunk and that she had told them she was a college student."

I hope nobody here ever has a son falsely accused of rape.
I think it’s funny that you want no one to believe the statements that there’s a police recording but then argue that everyone should believe the defendants attorneys statements.

And in statements such as the one the prosecutors give you almost never hear anything approaching “we think he did it but we don’t have enough.”

By his own admission he gave booze to a 17 year old and took part in banging her. Does it constitute a criminal charge of rape? Well, according to the prosecuter, not enough evidence.

But the facts are the facts... the guy is a scumbag.

Yep and again some of his own teammates reported his involvement to the school. That says quite a bit to me.

If someone else wants to sign him I won't complain, he's a phenomenal punter, but I personally want no part of him on any team I am a fan of

Just to clarify. Several student athletes in other sports went to the school and reported this and they went to the media and said 99% of the football team knows about this alleged 5 person rape, it's being talked about all over campus by them, so we're wondering why isn't the school doing more about it. To me that says to me when your peers are reporting you in a culture where coverups are very common.

If another NFL team wants to take a chance by all means, I sure hope we don't

SI and several others have it too most of them are citing the LA Times report. There's an internal system that allows students and faculty to report things anonymously and apparently MANY of them used it to report this incident and how disturbed they were about the apparent lack of effort by SDSU.


The reports to campus officials late last year revealed disturbing allegations about players from San Diego State University’s winning football team.

Claims were rapidly spreading among the school’s athletes that five players had raped an unconscious girl and left her bloodied and bruised at a house party off campus.

“I am very scared and worried that nothing is being done about this,” one student-athlete told university officials in a message sent through an anonymous reporting system, which was reviewed by The Times along with other internal campus records in the case.

I mentioned this before I have a 17 year old niece who's got SDSU on her short list of applied schools. When they visited, there was a student protest going on directly related to the Title 9 case with this alleged rape. I don't know if she's going to end up going there or not but it's a clear concern with the family because of the allegations of how poorly the school handled it.

I think it's in the original text messages he sent to the girl that she showed to authorities.

I'm not saying she is or isn't. But we don't know and it's certainly not "obvious". There are well documented cases or false rape accusations. Brian Banks the most obvious one. But just a quick Google of "false rape claim football" shows others. And remove football and there are more again.

Maybe Araiza is a nice church going, god fearing man that visits his granny every other weekend and his accuser is street trash who saw a chance to make some money off a guy she knew was heading for the NFL? We don't know.

What we know is he hasn't been charged with anything so for all intents and purposes he's no no different to any of us and should be allowed to continue his career free of reprisal.
According to reports there are photos of her bruising and evidence of some kind of an assault, along with a rape kit administered at the hospital. From what I've read, it seems like she was definitely assaulted or at least roughly treated... it's just the who that is unclear enough to bring up charges.

To some degree she may be "making it up," as in Arazia didn't rape her, but I think something happened. And regardless, he basically admitted to some sexual relations with her by mentioning the getting tested thing. And while I'm not going to demonize someone for hooking up with a 17 year old at a party (let's be honest, we all grew up and went to high school/college/whatever, that stuff happens), because it'd be legal in multiple states, it seems like he did and at least broke the law there.

I haven't quoted your second post, but I've been around situations in high school and college where people I knew (not close friends, but like, people who would be at parties I would go to) had been falsely accused, and some who were actual rapists. It's terrible.

When you get alcohol involved in these situations, especially if someone feels scorned or like they can get something out of it, it turns bad. I don't have a solution for it, people have had sex intoxicated since the dawn of time, and will continue to.

So, I'm still torn. I wouldn't bemoan signing him but I'd understand why people wouldn't want to. Perception does matter.

Have you ever been to a HS/colllege drinking party? Things happen all the time that people don't see.

Again college athletes are in some ways a tight circle because they deal with the same stuff, there's fights between football and basketball players stuff like that but it's not common for student athletes to do what was apparently done at SDSU, report rumors of an incident and ask why aren't you doing anything. And again this wasn't just women athletes reporting it I know that for a fact my niece's parents were told that by multiple people when she did her visit at SDSU, and she's not even a recruited athlete there if she goes to SDSU, she's going to be a regular student.

Police don't press charges on sexual assaults all the time as the lawyer said the minute alcohol gets involved it complicates things.

Unless someone comes out and says the story about her calling Araiza while detectives were listening is untrue, I'm going to stick with my opinion, something bad happened to that girl and it's being covered up by the people that did it, and the people around them which happens on pretty much every campus in the country at some point.

You're welcome to your opinion but opinions shouldn't effect people's careers when the law says there is no evidence to prosecute.

Never once have I defended Watson. In fact I made the very same argument that the law decides guilt. Not rumor and social media.

That's why he's starting on Sunday.

Again NFL teams are free to sign him. But yes they have a perfect right to NOT sign him too.

Araiza was the highest rated punting prospect since probably HOFer Ray Guy, and yet he was the 3rd punter taken. The draft day stories were all the same, the Bills were stunned he was still there, everyone was amazed 2 punters were taken before him, Jordan Stout 4th round Ravens, Jake Camarda 4th round bucs. Then when the rape allegations came out it was also reported that while the bills had NOT known when they picked him, other NFL teams DID know and several took Araiza off their draft board.

My guess is the lack of criminal charges may convince some teams to give him a second chance but there's still going to be teams who like on draft day just say no, we don't want that baggage on our roster.

NFL is a business, tons of money involved, they have a perfect right to decide they don't want someone

You can continue to say this, but just repeating the same lie doesn't make it true. Just like a prosecutor deciding not to press charges or a jury/judge choosing not to convict a person doesn't mean the person didn't commit the crime.

If you don't even understand this, I don't know where to begin.

Sorry for the long post but here is my experience on a similar situation:

My daughters friend was raped her Freshman year of HS by her “boyfriend”. She was 15 and scared so she didn’t come forward right away. A few months later she discovered that another girl had recently alleged that same boy raped her as well. As the word started to spread, 2 other girls came forward with similar stories about the same boy. My daughters friend decided that the right thing to do was to come forward in hopes that this wouldn’t happen to any other girls. She spoke to her school councilor, the school’s crisis councilor, as well as the on school Officer. An official report was filed.

During the investigation one of the girls dropped out of school and moved out of the state for a fresh start. She wanted to put everything behind her and didn’t want to make an official report. Another one of the girls gave her report but chose to remain anonymous. The third girl got scared when it was her turn to be interviewed and didn’t show up. My daughters friend was the only one willing to testify. Because of all this the county attorney, against the recommendation of the investigating officer, decided not to press charges because he was worried about being able prove “all the elements of the crime beyond a reasonable doubt”.

Im sure stories like this are a dime a dozen. Just because the county attorney doesn’t prosecute it doesn’t mean that the person isn’t guilty as hell.
