Florida's "Stand Your Ground" Law needs some re-examining...

    It's basically George Zimmerman 2.0, with this instigating wanna-be badass who, in this case, apparently made it his mission in life to make sure black people don't park in handicap zones.

    Just a thought: What if the shooter was black and the victim was white? Or make both parties black? Do you think the sheriff would have concluded so quickly not to even detain the shooter, much less charge him?

    Yeah, that was a bad application of the law. Yes, he was pushed very hard to the ground but the Dude had already backed off.

    There was no call for lethal force not that it may matter in Florida.

    You could fix this by simply removing the presumption that the shooter was acting in reasonable fear. Make this an affirmative defense when it occurs outside the home so the burden is on Defendant to prove.

    Inside the home, I think it makes sense to keep the presumption in place.
