The restitution hearing for former UFC heavyweight champion Cain Velasquez has been pushed back another month.
At a restitution hearing held Tuesday in Santa Clara County (San Jose, Calif.) criminal court, Velasquez's attorney Renee Hessling, district attorney representative Aaron French, and attorney Patrick Zakhary, who represents victims Paul Bender and Patricia Goularte, all agreed more time was needed. Velasquez was not present.
The restitution hearing was continued to July 22 by judge Elizabeth C. Peterson. The continuance is the second that has been granted to this hearing, as it was initially scheduled for April 16. Whenever it actually takes place, the restitution hearing will determine how much Velasquez owes the Goularte family.
Velasquez, 42, is currently in the midst of a five-year prison sentence at Soledad State Prison after he pleaded guilty to attempted murder and other charges.
In February 2022, Velasquez was arrested after he pursued and a shot at a car that carried Harry Goularte, a man accused of molesting Velasquez's four-year-old son at a daycare. Velasquez pursued Goularte, his mother Patricia Goularte, and stepfather Paul Bender, the last of whom he shot in the arm, causing non-life-threatening injuries.
Velasquez spent eight months in prison as he was repeatedly denied bail, until then-attorney Mark Geragos' relentless appeals paid off with a November bail allowance of $1 million with additional stipulations. Velasquez remained out on bail until March when he received his official sentencing, which included time served.
Velasquez is currently eligible for parole beginning in March 2026. Prior to his sentencing, Velasquez said he'd come to terms with his situation and wished no ill-will toward the Goularte family.
Goularte is due in court for a special hearing July 9, then again Aug. 4 for a master trial calendar hearing as he faces one felony count of lewd acts with a child. Goularte has pleaded not guilty and denies any wrongdoing. Civil lawsuits between the Velasquezs and Goulartes have been filed both ways.
