I still feel like a $200,000 fine is egregious.

I guess it depends on his salary, but still. I'm not even sure it's legal. Sure, they can fire you, but can they really fine you? I know I can't be fined at my workplace.

If I was fined $200,000, it would ruin my life. He's already got the legal fees. I hate coming to anyone's defense here, but it seems like he's just being hung out to dry because he makes more money.


I'm sure the fine is something that hurts but does not ruin his life at all.

I do. So I see where this comes from, but I certainly have no such conduct clause having to do with fines for off-property activity. Termination, sure, but nothing to do with fines.

No disrespect, but most employment contracts for senior level employees almost always contain language around the topic of personal conduct and how you represent the “brand.” If you don’t like the language, try to negotiate it out or, don’t sign the contract and go somewhere else...
