It is my understanding the Magic renounced their rights to Darko in order to sign Lewis.
Lewis isn't signed yet. All they have to do is execute a Darko trade five minutes prior to signing Lewis on the day free agency signings are allowed, and this problem goes away.
I kinda like this deal, actually - it gives the Suns a bona fide center prospect (Milicic), a classic Suns wingman with some size (Turkoglu), a nice young athletic player (Ariza), and a cash-generation device (first-round pick).
I have to admit I'm very intrigued by this deal. Not sure it makes the Suns better now, but I am very high on both Darko and Ariza, both of whom are just 22.

I don't think you can do that, but someone who know the CBA would have to say.
According to ESPN, the Magic still retain Darko's Bird rights. They did not renounce his rights, they simply withdrew his qualifying offer, making him an unrestricted free agent rather than a restricted free agent. Therefore, they can still go over the cap to resign him, or more likely include him in a sign-and-trade deal.
