There is a family of four illegal aliens(hispanic) driving in a car NB on I-15 from California to Vegas. They are halfway between Vegas and the stateline minding their own business and driving under the speed limit by 5 mph in the left hand lane of two lanes. A semi is driving along side them with their car in the rear 1/3 of the semi.
All of a sudden a Highway Patrol officer comes screaming up on the semi from the rear at an estimated speed of 110 MPH. He is going so fast that when he changes lanes into the left hand lane to get around the semi he doesnt have enough time to react and slams into the rear of the car that is carrying the family stated above. The impact causes the families car to go veering off the road and into the embankment which has about a 20 to 30 foot drop and is also damaged badly from the impact. The car rolls and three of the four in the car are killed instantly. One female in the car (preganant) survives but loses her baby in the accident as well.
Now it comes to light later that the HP officer was just speeding home for lunch and had no reason whatsoever to be going at such a high rate of speed. He is fired and brought up on charges for the accident. He has since been convicted and I believe has to spend a couple of years in prison.
Now the girl who survived is sueing the state of NV and the HP officer for an obscene amount of money.
Does she have a case? Should she be awarded damages?

I think even illegal aliens have a reasonable expectation of road safety and right to life in our country. The actions of the officer, based on your description, are criminally negligent and the state is clearly actionable.
Settle, let her cash in on her family's pain, and then deport her.

I think that's about right, but the settlement should be far more reasonable than what one would normally expect.

He has had no business doing that. Police officers are given extraordinary powers, when they abuse them the punishments should reflect that.
That the family was here illegally is irrelevant, it just as easily could have been Brighteyes and I. Sure deport them but it has no bearing on anything else.
If an American citizen were in another country illegally and they were the victim of a crime by a member of their law enforcement, then I would hope they were compensated in whatever way.
Being the victims of this crime shouldn't be their punishment, deporting them is. So I agree, settle and escort her to the border.

Why exactky do they have the reasonable expectation of road safety? They arent citizens of this country and are here illegaly. They have no reasonable expectation to anything. Our laws do not govern them. Our road taxes arent paid by them.
If they have a right to life in our country does that mean that they have a right to make a life in our country? Since they have a right to life here does that mean they should have a right to come across the border as they please?

You do have a reasonable expectation. You are here legally and contribute to everything that is in place to provide that road safety. These people do not.

If these people were here on vacation visiting legally with passports/entry/work visas and paying the rental car tax and the hotel tax etc... etc... they too would have a right to a reasonable expectation of raod safety IMO.

Great... by BIM's and Shane's logic, we should be able to murder, rape, whatever we want to illegals because our laws don't protect them. Your logic would make sense If I stated that the HP Officer should still have his job, not been tried for crimes in court and that it was BS that he was sent to prison for this. However I agree with all that happened to him and think it should have been stiffer then a couple year penalty. I just plain and simply believe they are not enitled to a settlement of any kind. Nice try though.
