My one concern is that I hire someone who has a prescription for MM, and one day he's really in pain, but can't afford to take the day off. So, he shows up to work, finds a nice quiet place, lights up, then tries to go do something before someone catches him - and gets himself hurt or killed in the process; or worse, hurts or kills someone else.
And I do hire based on who can do the best job. One of my best scraper operators that I've ever worked with had 1 arm - but man could he drive iron. But I'll be damned if I'm going to hire someone that could put someone else in jeopardy.
Regardless, I really don't see a stampede of people with prescriptions for either pain killers or MM applying for construction jobs - the work is generally too strenuous. If someone has really bad back pain, they're not going to spend 8 hours a day slinging mud, framing, wiring, hanging drywall, etc.

I'm not sure about that, nidan. People don't have prescriptions to take a shot of Jack Daniels, as far as I know. However, there may be legal protections afforded to those who have MM prescriptions. If those who have a prescription for MM do have legal prescriptions, and let's say they do have to use during the work day, does that mean I have to restrict them to light duty (sitting at a desk)?
Can I fire them? Or by doing so, will I get sued?
The devil is in the details - I'd have to see how the law is applied by the courts.
I'm not against MM at all, OTOH, I have a job to do and a project to complete, which I have to do as safely and as quick as possible. A person who used MM on the site would clearly present an unsafe condition.

What I meant was that for most jobs, being impaired on the job is the issue regardless of the cause of the impairment

The actual language states that a cardholder cannot be fired for the result of a positive drug test for marijuana. It also says that this protection does not extend to MJM cardholders using on the job. So even if they are a cardholder, they still have no right to light up at their place of work.

Meh - overall quality will go up on the street, but pricing won't change on the street.
Card holders will probably get 1/3 off of street pricing.

**** yes im going to use chronic pain to get pot, who cares? Now I can no longer be imprisoned and lose my children because I smoke a bowl one night.
I know people who get off work, get hammered and swerve home every night, focus your hate on that stuff not responcible pot smokers in their bedrooms.
