OKLAHOMA CITY, July 2 — An Oklahoma man arrested on suspicion of beating his wife faced year in prison and a fine. But when he spit in an arresting officer’s face, he got a life sentence instead, officials said on Wednesday.
JOHN CARL Marquez, 36, was convicted of “placing bodily fluid upon a government employee,” a felony that can carry a life sentence because of the possibility of transmitting a potentially deadly disease.
State judge April Sellers White sentenced Marquez this week even though Marquez and the officer tested negative for any communicable disease.
Marquez also was convicted of assaulting a police officer, and a jury recommended the maximum sentence because he had previous convictions.
Marquez, arrested several months ago, could have received one year in prison and a $3,000 fine for wife-beating, according to the Creek County court clerk’s office.
His lawyers said they plan to appeal.

I agree that the mans punishment is probably just a tad harsh. I could see a year in jail or so especially since it isnt his first offense!
But I am curious how all of you would feel if under the same situation he had given the officer HIV let say? I would most certainly feel that life in prison is a worthy punishment!

I would agree with that if the man was aware that he was carrying the disease.

I really wouldnt care if he knew or not. He would still be the one who carelessly and needlesly put his body fluids around the face of a police officer. The intent is malicious whether he knew or not. His actions ruined the life and essentially killed another man albeit a slow death.

To me it would warrant life either way?
I don't think it would warrant life. If he did not know he had the disease than the intent to kill would not be there. Reckless endangerment maybe. But if the guy had AIDS a life sentence would not take long to be completed anyway, so it is kind of a moot point. He already had a life sentence, he just wasn't serving it in prison.
