Allegedly, there's supposed to be this big 200K person march on May 1st, or something like that. Immigrants "rights" groups are behind the organization of this event.
Here's my take:
First of all, I am half Mexican. Secondly, to me, this is not a racial issue, though it absolutely is to a major portion of the anti-immigrant crowd. Finally, this is purely a Constitutional issue and a legal issue to me, end of story.
Illegal immigrants have no rights, period. Human rights? Sure. No one should be expected to live in bondage and servitude or be killed regardless of your citizenship (or non-citizenship) status. I think human rights are global (should be) and inherent.
Illegal immigrants have no right to come here and march on our Capitol to demand anything. They do not have the right to free speech. That is an American right, a Constitutional right afforded to American citizens. They are NOT American citizens and they have no right to co-opt our rights as their own.
Illegal immigrants do not have the right to assembly (peacefully or otherwise), period. Again, that is for the exact same reasons I listed with regards to free speech.
Illegal immigrants do not have the right to demand in-state tuition. First of all, you should not have the right to be freely admitted to our STATE-FUNDED universities, let alone demand the lower in-state tuition rate. Pelosi's so-called "Dream Plan" is a joke. Do I now have the right to go to California and demand in-state tuition rates at UCLA even if I am not a legal California resident? Illegal immigrants are not legal California residents either. I guarantee this will be a lawsuit coming down the pipes. So, IF illegal immigrants are going to be admitted into our universities, they should do so at the cost of out-of-state rates at the minimum. If I were in charge, I'd have a 3rd tier - a higher rate for non-citizens.
Illegal immigrants have no right to demand access to state welfare programs or other assistance programs. If they need help getting food or money, find private donors, period. This big machine organizing this BS should funnel their money instead to the same illegals that need teh financial assistance they are demanding.
On the flipside, legal immigrants DO have the right to all these things. Am I sympathetic to the massive desire to be her? Sure. Am I aware that there is a horrible backlog causing excessive delays? Definitely. Should there be a more efficient way of streamlining the process? Yes. However, we should establish quotas and be firm on that.
I approve of the fence idea, but it frankly needs to be accross both borders. On the Southern border, we have a problem of illegal immigrants coming across. On the Northern border, we have the problem of terrorists coming across.

No, the Constitution should not be changed at all. However, how we enforce birth right should. If an illegal immigrant births a child here, they have the option of leaving their child here in America to be born and raised in the foster care system, or they can take their child back with them as they are deported. they surrender all rights to that child to the state if they choose to leave the child (an American citizen) behind. It's their choice. But, coming here and having a baby is no longer a motive. They have no right to contact or follow up with the child.
Harsh? Yes, but it is a choice that the illegal immigrant parents get to make....

Just like you said, if they are illegal, they have no rights. (or shouldn't have any) What really pissed me off, is that last year, when they held one of those things, we spent $250,000 on water, food, etc for illegal immigrants, so that they could protest.

Constitutionally, I don't think that the state can do that. Unfortunately, it's a catch-22. You know that you know that there will be a great number of illegal immigrants, but I will not surrender the rights of the legal US citizens that are there in order to allow a sweep. I hate that I feel that way, but I think it's strictly a Constitutional issue....

Um, why not? I'd be curious to see the constitution for this matter. So, if you are suspected of being an illegal immigrant, or a terrorist, you cannot go after them? What is the INS for then?
1. Control the border. Something the Feds don't seem inclined to do.
2. Make it easier for Mexican citizens to move back and forth for employment or to visit family. Something the Feds don't seem inclined to do.
After that if you are here illegally go to jail then get deported.
The fact that police can't arrest people for being here illegally is ridiculous. Almost as ridiculous as making legal immigration difficult while leaving the boarder mostly open. I call shenanigans.
You can't just go up to random people and demand proof of citizenship as far as I know. Your Constitutional right to privacy extends to your person, your possessions and your effects, or something like that....
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
So, unless INS can legally get a blanket warrant, they can't do what you propose. I have never heard of a blanket warrant, so I'll now defer to one of the many lawyers on our board....
Just curious.....I know about the 4th amendment, but how does that relate to the Patriot Act?
Um, why can't you require identification to join the protest? If someone cannot show proper identification, that to me is probable cause. Besides, can't you hold someone suspected of being an illegal (or any crime for that manner) for 48 hours without charging them with a crime?
How does the INS prove that someone in an illegal? Do they have to wait until they commit a crime? Like Chaz said, until we can control the border, we will not know if a person that is coming or going is illegal or not.
Besides healthcare, this is probably the issue that I am most passionate about, yet it is something that has no solution in sight.
