Fla. judge rules saggy pants law unconstitutional

RIVIERA BEACH, Fla. (AP) — A judge has decided a law banning sagging pants in this town is unconstitutional after a teenager spent a night in jail on accusations he exposed too much underwear.

Julius Hart, 17, was charged last week after an officer said he spotted the teenager riding his bicycle with 4 to 5 inches of blue-and-black boxer shorts revealed.

Hart's public defender, Carol Bickerstaff, urged a judge Monday to strike down the sagging pants law, telling him: "Your honor, we now have the fashion police."

Circuit Judge Paul Moyle ruled that the law was unconstitutional based on "the limited facts" of the case. Technically, however, the charge hasn't been dropped yet: a new arraignment awaits Hart on Oct. 5.

Voters in Riviera Beach approved the law in March. A first offense for sagging pants carries a $150 fine or community service, and habitual offenders face the possibility of jail time.

Bickerstaff said she wants the city to drop the law — regardless of whether anyone dislikes low-riding pants.

"The first time I saw this particular fashion, I disliked it," she told the judge. "And then I realized I'm getting old."

I think it is unconstitutional. Freedom of expression. Unless you see ass crack, it can't be indecent exposure. Dude is covered by cloth.

When I play rock, paper, scissors, I keep a glass of water in my hand and when my opponent throws down I throw the water in his face and say "Water". Beats all three, scissors can't cut-it, paper dissolves and the rock sinks. Plus it usually surprises the hell out of them.

Donald, I completely agree with you on that statement.

Our government has been passing laws for far too long that don't even need to be written. For example: Texting illegal while driving; well no crap, are there that many people in America who do not realize that it isn't safe to text while you drive? I don't need my government to tell me what common sense does.

Frankly I could care less if someone wants to wear his pants below his ass.
I actually find it amusing.
One hand grabbing your pants so they won't fall down because the belt is cinched below your ass.
You have to waddle just to walk.

2 divergent paths to recognition. Do something "outstanding" or do something to "stand out". One is very easy.

It would seem that this is one of those battles not worth fighting. Wise people pick theirs battles wisely. BFD. Baggy pants, crotch grabbers won their constitutional right to be ridiculed by judgmental people who have nothing better to do. At least it keeps the cheap entertainment factor alive. Some of those outfits are worth the price of admission.
