MEXICO CITY - Mexican President Vicente Fox said Friday that the International Court of Justice and the United Nations will have to take action if the United States does not comply with a ruling that it review the cases of 51 Mexicans on death row.
In an interview with the board of directors for the Associated Press Managing Editors, Fox declined to say, however, whether Mexico would take additional measures if the U.S. government does not follow the order.
"We don't have any actions planned because we're expecting (the United States) to comply," he told the APME board of directors, which represents 1,700 newspapers in the United States and Canada. The board of directors is meeting this week in Mexico City.
The International Court of Justice, the United Nations' highest judiciary, ruled Wednesday that the United States violated the rights of Mexican inmates by denying them assistance to their government. That right is guaranteed under the 1963 Vienna Convention.
The court ordered the United States to review the Mexican cases, but the U.S. government has ignored the court's rulings in the past.
Wednesday's ruling raised questions from the eight states holding the inmates, but no assurances that they will try to address the court's concerns.
Mexico's Foreign Relations Department said this week that if U.S. officials do not comply voluntarily, Mexico would consider asking the U.N. Security Council to issue a resolution urging them to do so.
The death penalty has been a sore point in Mexican-U.S. relations, with Fox canceling a trip to meet with President Bush in 2002 after Texas executed a Mexican man convicted of killing a police officer. Fox is a strong opponent of the death penalty.
He said Friday that he hoped the United States would not only review the Mexican death penalty cases but ensure that all future foreigners convicted of a major crime had access to consular assistance from their governments.
In a wide-ranging interview, Fox also said his government would release a report in two weeks on the slayings of hundreds of women in the northern border city of Juarez. He said the report contains recommendations for weeding out corruption and would be "bad news for those who have not complied with the law."
Mexican and international human rights groups have harshly criticized state and federal government agencies for failing to resolve the killings. State investigators have been accused of using false evidence and torture to solve the cases.
Fox said his administration was doing everything possible to improve living conditions in the rough border city, including sending 500 federal police to the city and ensuring that women are paid equally and treated fairly in the many assembly-for-export plants. Such female factory workers have been the victims in many of those killings.

Why is there a thumbs down on this post? He's not making any exorbitant demands, he just wants people to have the rights that they should have under the law. I personally am pro-death penalty and I think the whole appeals process is too long and expensive, but convicts still have legal rights under law....

What Fox really wants, is for citizens of Mexico who commit capital murder here, to be treated as if they are under the laws of Mexico (no capital punishment).
I have mixed opinions on the death penalty; over time I've felt (emotions) that some people just should be killed for their crimes. Fox doesn't agree, and he's basically trying to force us to treat his citizens as if they committed the crime in Mexico.
This is a sovereign country, and anyone who comes here is subject to our laws. If I were to try and smuggle a kilo of cocaine into Singapore, I would get the death penalty. I know that's the punish over there, and I give them the right to punish me when I enter their country (social contract).

I didn't read that into that article. I could see your point if that's what he were trying to do. I think it would be highly presumptuous of Fox to think that he could even fathom trying to change our laws when he and his country are so dependent on us for jobs in Mexico, jobs in the US, money from tourism, and money from trade. Mexico makes over well on us.....

Definitely. Mexico is our dependant. Without us, they would likely starve.
This brings a conundrum; we respect the international community and want to do business in the world, but we can't allow other countries to try and force their laws upon us.

But, if we signed the Vienna Convention, shouldn't we abide by the rulings based on it, or abrogate the treaty?
We can't sign treaties, but then ignore provisions we don't like. Wasn't that one of the justifications for invading Iraq?
The United States is definately in bad company when it comes to the death penalty - most, if not all other democracies do not have the death penalties - only found in dictatorships like China and Saudi Arabia.

Not exactly the beacons of light in this world.
As I said, I have very mixed opinions on the death penalty.
Since I'm not a Christian, and I don't think we will be "judged" after life, that part of me wants to see people pay for their crimes.
But it isn't exactly justice; if one innocent man dies, the entire system is wrong.

I don't think a single case has been proven that anyone totally innocent has been executed in the last 50 years. The system is working pretty well.
No offense (I respect you) but this is a pretty naive position. Since the advent of DNA, deathrow inmates have been exonerated. If they are exonerated today, it doesn't take a huge leap in logice to assume that a few innocent people have been executed.
