Unborn HOV lane? Mother to fight ticket

A pregnant Ahwatukee Foothills resident ticketed for driving in a carpool lane is scheduled to appear in court today to argue that her unborn child counted as a passenger.

Candace Dickinson, 23, hopes to overturn her penalty and prove her point that even though her child was still in the womb while she was driving on Interstate 10 on Nov. 8 in Ahwatukee Foothills, it still counted as a second person.

Since then, Dickinson gave birth to her baby - a boy.

Frank Valenzuela, spokesman for the Arizona Department of Public Safety, said a vehicle can't occupy the high-occupancy vehicle lane unless two or more people are in it.

The statute doesn't define what a "person" is.

"If a (pregnant) mother goes to a movie theater, she's not going to pay for her child," Valenzuela said.

Dickinson could not be reached for comment.

She faces $390 in fines and is to appear in Phoenix Municipal Court at 1:30 p.m.

this happened years ago (to a different lady, of course), and the woman got off.

interesting concept .. don't think she should be able to do it though

just like I don't think a child should allow you to ride HOV as well ... there is no carpool/environmental benefit to having a non-driver in the vehicle with you

I agree entirely - always been my argument that to qualify for the HOV lane, you should have at least two licenced drivers aboard.

easy .. many other states have this as their requirement

see 2 passangers, but one looks under 16 - pull them over

16+ it becomes more difficult because who is to say who's licensed ..... but definitely would help

AZ is weird with their HOV laws - i'm pretty sure that hybrids don't qualify as an AFV, which is weird

There is already precidence on this type of case, she ain't gonna win. Cops don't even count midgets as a whole person.

at 16+ it would become more tricky and it may not hold if they pull you over for violation of HOV regulations as there is no visable evidence you are violating the law

however, say you were pulled over for reckless driving - then the cop could run you buddy to see if he has a license and if he doesn't add on another charge

You should never drive with someone sitting in your lap!

The woman in the referred case is really pushing it. The entire concept of HOV lanes is to reduce the number of vehicles on the road. that is why the suggestion by Jon make so much sense. The fact that the woman's baby is not even able to occupy another seat, let alone another vehicle makes her attempted defense hollow.

As suggested, I think the same woman would be outraged if a movie theater or similar charged her for two admissions.
