Bill Janklow should resign

Bill Janklow has been a longtime public servant for the people of South Dakota. He was governor for 16 years, and before that served four years as attorney general. Most South Dakotans returned him to office and elected him as their U.S. representative in 2002 because of his effectiveness as a public leader. His involvement in a fatal accident in which he was charged with a felony on Friday calls into question his effectiveness to serve as South Dakota's lone representative in Congress.

Moody County State's Attorney Bill Ellingson charged Janklow with second-degree manslaughter, a felony with a maximum penalty of 10 years in prison and a $10,000 fine, failure to stop, going 71 mph in a 55-mph zone and reckless driving for the Aug. 16 accident near Trent that killed 55-year-old Randy Scott of Hardwick, Minn. Scott's Harley-Davidson struck the rear door of Janklow's 1995 Cadillac after Janklow ran a stop sign. In a sworn statement, the South Dakota Highway Patrol investigator said Janklow told him he saw the stop sign but was going too fast to stop before the collision.

Ellingson's decision to charge Janklow with second-degree manslaughter is consistent with South Dakota case law and appropriate to the facts of the accident as we know them. We cannot fault Ellingson for waiting 13 days before filing charges, given the amount of attention this case has brought. If any case needs to have the facts thoroughly investigated and all the i's dotted and t's crossed, this is it. The public pressure to prosecute Janklow has been intense. The judicial process is working as it's supposed to, and we urge people to let the prosecutor, defense counsel and judge do their jobs.

Everyone is entitled to the presumption of innocence before being proved guilty in a court of law. But are the basic facts of this case even in dispute? Janklow entered an intersection in which he had a stop sign posted and collided with a motorcycle, killing the driver. Janklow has not disputed those facts, and he has expressed remorse for the accident. Nor is this the first time Janklow has driven recklessly and broken the speed limit; he has 12 speeding violations on his record. The state must prove that the facts warrant his conviction on a felony charge of second-degree manslaughter, but the facts alone argue for negligence of some degree on Janklow's part. What's left to decide is whether his punishment is more fitting of a felony or of a misdemeanor conviction.

In either case, Janklow should resign his position as a U.S. congressman. We don't see how he could continue to effectively serve as South Dakota's at-large representative with these charges hanging over his head. If he is convicted of the felony charge, he would lose his voting privileges in the U.S. House of Representatives and could not participate in committee meetings until his record is cleared or he is re-elected. For most purposes, South Dakota would lose its representation in the U.S. House.

More than that, Janklow already has lost the moral authority to continue to serve as South Dakota's congressman.

Bill Janklow has been a loyal public servant for the people of South Dakota for most of his life. His next step on behalf of the people he has served so well should be to resign as U.S. representative for South Dakota.

The guy has a history of speeding and driving too closely, etc. A regular guy likely would have had his license suspended for the number of tickets he has received.

It sounds as if he is guilty of speeding, running a stop sign and causing the death of the motorcyclist. I do not buy the diabetes angle, and even if it were true, he is still responsible...even more so.

Actually, Rep. John Thune is considered THE prime challanger to the minority leader Dashle.

Sad to think that's the value placed on the life of the 55 year-old man he killed.

Just wondering if they offered him a plea before this went to trial. The dude who killed my friend (speeding and close to legally intoxicated) was originally charged with manslaughter but pleaded to death by auto, I believe. Less of a sentence. (30 days in jail with work release. I think my friend's life was worth much more than that!)

What is a human life worth?

Leonard Little drove drunk, ran a red light, plead GUILTY to manslaughter, got a 3 month jail sentence and a 4 game suspension from the NFL...then he got a SB ring later that season. Murdering scum.

Makes me sick.

Janklow should be doing hard time for a long time.
