Photo Radar

My wife got a ticket for speeding by photo radar awhile back and then today we got a flyer in the mail promising a way to beat the citation. For $65 a guy named "Joe Geremia, Jr." of "Angel Enterprises" will show you how to:

Not pay the fine
Not have any points added to your license
Your insurance company will never know you were issued a citation

He gives his phone number and address in Cave Creek to answer any questions, so he seems fairly legit. Anyone else ever get one of those flyers?

I already know what he's going to tell you. He's going to give you a list of case citings to give in court and to ask for a dismissal because you have a right to face your accuser in court and since the photo radar is a computer you can't exercise that right. Theoretically the judge should toss it out but I'm not sure

Yeah. I was thinking the same thing. I'd ask to face my accuser. If they couldn't present one, i'd ask that they throw it out as it violates my constitutional rights.

They just put 14 of those stupid photo radar vans in albuquerque. 1 mph over the posted limit and they send you a 100.00 fine. There is no option to see a judge. If you want to contest you must see a safty officer.

What a crock of BS.

What his stuff tells you to do is to not respond to the ticket. It is sent via mail, so they can't verify you recieved it. Then you don't take any certified mail for 2 months or so, and then you don't answer the door for 60 days (process servers). They usually only try to serve you once or twice, and they don't keep coming back due to the way the system works...me being way out in Anthem, they only come once.

If you are not served, the ticket is dismissed. If you are served, you have 30 days to appeal or do traffic court or what have you.

I did this, and avoided a photo radar ticket a few years ago...it shows up on my record as dismissed.

There, just saved you $65.

True, but I've heard those servers can be very persistent since they only get paid if they serve you. One person told me on Valentine's Day he pretended to be a flower delivery person and when she opened the door, she was served!

Maybe he's a defensive driving teacher?

Can't she just take a class and have it washed away?

Gotta be careful with that one. My husb got stopped by an officer last fall, while she was writing the ticket, she got a call & had to run off. She told him she'd just mail the ticket. Well, my dear husb had our physical address on his license, not our mailing addy. So the ticket never came. We waited & waited. thought maybe she blewit off. I told him to just call to find out what happened but he never did. Then about 2 months ago, I get the mail & there's a notice from DMV his license is suspended for failing to appear in court. He goes to court & the judge said it was a $1000 fine!!!!!!!! Husb explained the situation regarding the addy & the judge changed it to $150 fine and dismissed the ticket. BUT, saying you "didn't get the ticket" didn't matter much to the judge. He only let it slide because of the actual wrong address.

Maybe it's different with photo radar vs. a real live officer??? I dunno.

that's it exactly. my grandfather just paid this guy (or someone like him) and got that same advice. someone came to his house to serve him the ticket, but he wasn't there and they never came back.

i thought they got paid either way, which is why these cases often get dismissed. it's not worth it to pay somebody $50 a go-round to try serve someone more than once for a $150 ticket.
